Due Diligence Clause

a. This Contract is subject to and conditional upon the Buyer completing due diligence investigations in relation to the Property including the land and any other surrounding or associated matter within 14 days from the Contract Date(Due Diligence Date).

b. The Seller agrees to give the Buyer reasonable access to the Property for the purposes of this Special Condition.

c. If the Buyer is not satisfied with the results of their due diligence investigations in their sole discretion then the Buyer may terminate this Contract by notice to the Seller at any time before 5:00pm on the Due Diligence Date.

d. If the Buyer terminates this Contract under this special condition any deposit paid is to be fully refunded to the Buyer within three (3) days of termination.

e. Should the Buyer not give notice of satisfaction, wavier or termination pursuant to this special condition by the Due Diligence Date then the Seller is able to terminate this Contract by notice to the Buyer, and this shall be the Sellers only remedy for the Buyers failure to give notice in accordance with this special condition.

f. The Buyer may waive the benefit of this Special Condition at any time.
